1 This action was commenced in May, 1963, on behalf of the State of Oklahoma, by its Attorney General, as plaintiff, to recover the face amount of certain state warrants from the Liberty National Bank & Trust Company of Oklahoma City, as defendant. The defendant entered a demurrer to the plaintiffs amended petition which was sustained by the trial court on October 11, 1963. The plaintiff declined to plead further and appealed to this court on the original record asserting that its amended petition alleged a cause of action. The parties will be referred to in this opinion by their trial court designations, with the exception that the plaintiff will also be referred to as "the State".
